Terms & Conditions
These Terms and Conditions govern all services provided by PopLife Photo, a photo booth rental company based in San Francisco, California. By booking services with PopLife Photo, the Client agrees to the following terms.

2. BOOKING AND PAYMENT
A signed agreement and non-refundable retainer of 50 percent of the total invoice amount are required to secure the event date. No date is reserved until the retainer is received.
The remaining balance is due no later than seven days prior to the event date unless otherwise agreed in writing.
If the balance is not paid by the due date, PopLife Photo reserves the right to cancel services without refund of the retainer.
3. CANCELLATION POLICY
If the Client cancels more than 30 days before the event, all payments made beyond the retainer will be refunded.
If the Client cancels within 30 days of the event, all payments made are non-refundable.
If the event is postponed, PopLife Photo will make reasonable efforts to accommodate a new date, subject to availability. If unavailable, the cancellation terms apply.
4. EVENT REQUIREMENTS
The Client agrees to provide:
- Adequate indoor or covered space for the equipment
- Access to a standard 110 to 120V power outlet within 25 feet of setup
- Sufficient setup and breakdown time as outlined in the agreement
- A level and dry surface for all equipment
PopLife Photo reserves the right to refuse operation in unsafe conditions including rain, extreme heat, excessive wind, unsafe flooring, or hazardous environments.
5. DAMAGE AND LIABILITY
The Client is responsible for any damage, theft, or loss of equipment caused by guests, venue staff, or any third party during the event.
The Client agrees to indemnify and hold harmless PopLife Photo from any liability, claims, or damages arising from the use of the photo booth during the event.
PopLife Photo is not responsible for injury, property damage, or technical failure beyond its reasonable control.
6. OVERTIME
If additional hours are requested during the event, overtime will be billed at the agreed hourly rate and must be paid within seven days following the event.
Overtime service is subject to staffing availability.
7. IMAGE RIGHTS AND USAGE
Unless otherwise agreed in writing, PopLife Photo retains the right to use photos, videos, and digital content captured at the event for marketing, promotional materials, social media, website portfolios, and advertising purposes.
If the Client wishes to opt out of promotional usage, written notice must be provided prior to the event date.
All images are provided for personal use unless commercial licensing is separately agreed in writing.
8. DIGITAL DELIVERY
Digital galleries are typically delivered within three to five business days after the event unless otherwise stated in the agreement.
PopLife Photo is not responsible for delivery delays caused by technical issues, file corruption, internet interruption, or force majeure events.
9. FORCE MAJEURE
PopLife Photo is not liable for failure to perform services due to circumstances beyond its control, including acts of God, government restrictions, natural disasters, venue closures, transportation disruptions, or other unforeseen events.
In such cases, payments may be credited toward a future event date if rescheduling is possible.
10. LIMITATION OF LIABILITY
In the event of total equipment failure or inability to perform services, liability shall be limited to a refund of all payments received.
PopLife Photo shall not be liable for consequential, incidental, indirect, or special damages.
11. GOVERNING LAW
These Terms and Conditions are governed by the laws of the State of California. Any disputes shall be resolved in the courts located in San Francisco County, California.
12. ENTIRE AGREEMENT
These Terms and Conditions, together with the signed booking agreement, constitute the entire agreement between the parties and supersede all prior discussions, negotiations, or representations.
By booking services with PopLife Photo, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
